For which goods and for how long does the seller's liability and warranty against defects apply?

Hansapost.ee the seller of the goods is responsible for the quality of the goods sold on the platform. If at the time of sale the goods were sold with defects, you have the right to use legal remedies under the conditions set out in the Rules of Purchase and Sale. If you are a consumer, the seller is liable for any lack of conformity that occurs within two years of the delivery of the thing to the buyer, with the presumption that the lack of conformity existed at the time of delivery within one year of delivery. After one year, the seller may ask you to prove that the non-conformity existed at the time of delivery. Also, the seller can offer a commercial guarantee. The terms and conditions of the warranty against defects are set out in the rules of purchase and sale and specified in the product description or purchase invoice. The applicability, validity period and terms of the warranty against defects may vary depending on the product and the seller.

Where do I turn to for warranty service?
To save time, we recommend that you deliver the product directly to the warranty service specified by the manufacturer. By contacting the repair company directly, it will be possible to repair the product faster in a couple of days. Which goods are not covered by the warranty?
The quality guarantee does not apply if the characteristics of the product correspond to its description and the product can be used according to its intended purpose. A quality guarantee is also not provided for storage media or information contained in the device. This means that we are not responsible if personal information on the device is lost during the repair. Also, expenses are not reimbursed if the customer wants to recover his data. Upon receipt of the goods, immediately check whether they have been damaged and make sure that the goods are in good order and correct. When receiving an order from the courier, pay attention to the packaging – in case of any doubt, unpack it immediately. Mark the observed defects in the document confirming the receipt of the goods and write a report in the presence of the courier or Hansapost.ee representative. If you notice any defects after signing the acceptance document, we cannot be held responsible for the damage or defectiveness of the product or packaging. What if I feel that the product is of poor quality?
If you suspect that you have received a defective product, you have several options:

  • If the defects of the product can be eliminated, you can contact the seller. 
  • It is possible to apply a discount to the purchased goods according to the value lost due to defectiveness.
  • It is possible to exchange the product for an identical quality product, unless the defects of the product are minor or caused by your fault.
  • You can return the product, and if the seller finds that the returned product does indeed have significant defects, you will receive a refund of the money paid for the product. The refund period is 14 calendar days from the date of confirmation of the defect of the product by the seller.

In all cases, the goods are sent to the manufacturer and / or authorized service provider for inspection and identification of possible quality defects. The inspection can take up to 3 weeks.

Please note that if you are a consumer, the seller is only liable for such non-conformities that occur within 2 years of delivery of the goods. It is assumed that the deficiencies revealed within one year of the transfer were present at the time of delivery. If the defect becomes apparent later, you are obliged to prove that the defect existed at the time of delivery. If the goods are covered by a commercial guarantee that is more favourable than these conditions, the seller may also be liable at a later date.

If you are a Consumer and you have purchased the goods from Hansapost.ee e-shop and decide to return the purchased item without a reason, it is possible to do so within 14 calendar days in accordance with the terms and conditions of the purchase and sale rules.

Under certain conditions, Hobby Hall GROUP OÜ, as a seller, also offers an additional money-back guarantee. It is valid after 14 days, but not longer than 30 days after the delivery of the goods. In this case, a number of additional conditions apply to the product. The packaging of the product must be undamaged, all authentic labels and protective wrappers must be carried, and the product must look exactly as it was when the goods were purchased. If you have damaged the packaging, it will not be possible to return quality goods or get a refund after 14 days.
If you purchased furniture, then this type of product is covered by an additional 365-day money-back guarantee. The product must be returned in its original packaging, in correct and undamaged packaging, and it is not possible to return furniture that has been assembled or attempted to be assembled. It is important to mention that the product must not have lost its commercial appearance, and it must be returned with the same parts that were attached to it, as on receipt. The money-back guarantee does not apply to furniture purchased in installments.

Goods sold by other sellers may be subject to warranty conditions other than those described above, which are specified in the product description and / or sales documents.

Categories of goods subject to specific obligations
As a rule, it is not possible to return high-quality goods (without defects) unless you are a consumer and withdraw from the contract within 14 days and the conditions for withdrawal are met.

We apply separate warranty obligations to certain categories of goods.

  • DVDs and CDs, computer games. DVDs and CDs, computer games with sound or visual defects can be returned to us. In this case, the product with a manufacturing defect will be replaced with a quality product, or you will be refunded the money paid for the product. As a rule, it is not possible to return high-quality DVDs, CDs or computer games after 14 days.
  • Cosmetics and perfumery, hygiene products. If you purchase cosmetics, perfumery or hygiene products of inappropriate quality, you have the right to return these products to us. In this case, a poor-quality product is exchanged for a quality product for free, or the money paid for the product is refunded. As a rule, it is not possible to return high-quality cosmetics, perfumery and hygiene items after 14 days.
  • Baby and children's goods. If you purchase a product of inappropriate quality for your baby or child, you have the right to return it to us. In this case, a poor-quality product is exchanged for a quality product for free, or the money paid for the product is refunded. Certain products intended for babies and children (for example, baby furniture) are covered by a manufacturer's warranty, the terms of which can be found in the description of the specific product and in the warranty cards. High-quality goods for infants and children can be returned only within the period specified in the legislation and our Purchase and Sale Rules and only in accordance with the requirements specified in clause 11 of the Rules. The cost of returning the product in this case will be paid by you. As a rule, high-quality underwear and hygiene items for babies and children cannot be returned after 14 days.
  • Optics and electronics, mobile phones, computer and household appliances. All these goods are covered by the manufacturer's warranty, the conditions and rules of which can be found in the product descriptions and warranty cards of the respective products. The warranty obligation on the part of the manufacturer of the product is valid only if the terms of use of the product, which are specified in the warranty card, the product manual and the website, have not been violated. Goods that have been manufactured in accordance with the buyer's special wishes and personal instructions and the buyer's choice are not subject to the right of withdrawal pursuant to § 53 (4) of the Law of Obligations Act and it is not possible to return high-quality goods. Information on whether a particular product is subject to a restriction as defined in this paragraph is provided in the product information sheet on Hansapost.ee page.
  • Furniture All products in this category are subject to a 365-day warranty, all conditions and additional information of which can be found in the descriptions of a particular product, warranty coupons. The warranty obligation on the part of the manufacturer of the product applies only if the conditions of assembly and use of the product have not been violated. After purchasing one of the items of this category, the product must be carefully inspected before assembly. If, after purchasing the goods, you notice that the product is of poor quality, you have the right to return such goods to us within the term specified in the product's warranty card. In this case, a poor-quality product is exchanged for a quality product for free, or the money paid for the product is refunded. If you notice hidden defects in the product during the warranty period, take a photo of them and send us a photo instantly by e-mail [email protected]. The manufacturer of the goods then determines whether the defect in the product is covered by the warranty, i.e. whether the defect in the goods is due to the factory. We will immediately notify you of the manufacturer's decision by means of communication specified by you.
  • Underwear, nightshirts, pajamas, tights, stockings, socks. If you have purchased underwear, nightshirt, pajamas, leggings, stockings or socks of inappropriate quality, you have the right to return these types of goods to us. In this case, a poor-quality product is exchanged for a quality product for free, or the money paid for the product is refunded. As a rule, high-quality underwear, nightshirts, pajamas, tights, stockings or socks cannot be returned after 14 days.

 

How long does the repair take?
Repairing defects caused by the fault of the manufacturer usually takes 2-3 weeks from the moment the product is delivered to the warranty service. If it turns out that the repair requires the delivery of parts from abroad, the waiting time is increased to 45 days.
Is it possible to secure the purchase / extend the warranty?
When buying from Hansapost.ee, it is not possible to purchase additional accident insurance or extend the warranty period.

Which goods cannot be returned?
The right of withdrawal from the contract, valid for 14 calendar days from the delivery of the goods, does not apply in the cases provided for in § 53 (4) of the Law of Obligations Act. Among other things, there is no right of withdrawal from the contract if:

  • The Goods are manufactured taking into account the personal needs of the Consumer;
  • The Goods are manufactured in accordance with the conditions provided by the Consumer;
  • The goods are perishable or aging;
  • The goods have been handed over in a sealed package, have been opened after delivery and are therefore not eligible for return for health or hygiene reasons;
  • Goods are newspapers, magazines or other periodicals, unless a contract of durability has been concluded for the ordering of such Goods;
  • The goods are audio and video recordings or computer software in a sealed container, if the Consumer has opened the container;

Please note that if you return the purchased goods within 14 days of receiving the goods, you are entitled to a refund of the full purchase price only if, before returning, you have used the goods only in the way necessary to ascertain the nature, characteristics and functioning of the goods in the way that would normally be allowed in a physical store. If you have used the goods in any other way than is necessary to ascertain the nature, characteristics and functioning of the item, you are responsible for the decrease in value caused by the use of the goods. The same applies if you return damaged or destroyed goods. In this case, the seller has the right to offset against the purchase amount an amount corresponding to the cost of repairing, replacing or restoring the goods to a new state or to an objectively justified loss.

If you wish to use the additional guarantee of refund and return the goods after 14 days, but not later than 30 days after receiving the goods, it is not possible to return goods from which authentic labels, protective films, original packaging or the sales appearance of which has been damaged. It is also not possible to use the additional guarantee for the following goods:

  • Hansapost.ee gift cards;
  • packaged goods which have been removed from the pack after delivery and which cannot be returned for health or hygiene reasons;
  • baby clothes;
  • toys, toys for infants, childcare products for infants;
  • goods which were manufactured or obviously adapted for that purpose by the Buyer or which, by their nature, cannot be returned due to the loss of commercial characteristics after being handed over to the Buyer, are perishable or their shelf life expires;
  • products included in the product range for adults;
  • Shoes; 
  • clothes.

Where can I return the goods?

Goods can be returned to a parcel machine, post office or courier. Otherwise, it can be sent with either Omniva or DPD and the recipient's address must be indicated: Hobby Hall Group OÜ, Rukki tee 7, Lehmja küla, Rae vald, 75306, Tallinn, Estonia. When returning, please indicate the recipient's phone number: +372 5551 5741. When returning the goods, please also send a corresponding letter to the e-mail [email protected], which indicates the products to be returned, the reason for the return and the tracking code created during the return. Please pack the products in such a way that they are not damaged during shipping. If a product is damaged during shipping, we are unable to provide an additional warranty and we may offset the cost of repairing or replacing the product against the refundable purchase amount.

The Buyer shall bear the direct costs related to the return of the Goods, unless the Parties have agreed otherwise.

Is it possible to bring outdated electrical or electronic equipment to Hansapost.ee pick-up point?
Yes.

Electrical and electronic equipment contains hazardous substances that pose a risk to the environment and human health. Therefore, these types of end-of-life products should not be discarded along with other household waste. By purchasing an electrical or electronic product from Hansapost.ee e-shop, you can bring the same type of unusable device to our pick-up point.

What are the differences between the manufacturer's warranty and the manufacturer's warranty for natural and legal persons?
 

Certain goods are subject to the manufacturer's warranty, the terms of which are specified in the description of the goods and in detail on the warranty card. The manufacturer's warranty is valid for 24 months for natural persons and 12 months for legal entities.

Asus, Dell and Acer computers and monitors are covered by a 24-month manufacturer's warranty for both natural and legal persons.
